Arvind Kejriwal Granted Bail: The AAP leader is set to be released from jail after almost six months of imprisonment without trial, following his successful bail in the previous case initiated by the Enforcement Directorate.

New Delhi: The Supreme Court has granted bail to Delhi Chief Minister Arvind Kejriwal, stating that his “extended incarceration amounts to an unjust deprivation of liberty.” Kejriwal was arrested by the Central Bureau of Investigation in June related to the alleged liquor excise policy case.

The Aam Aadmi Party leader is now set to be released from jail after almost six months without trial, having already secured bail in the case initiated by the Enforcement Directorate. However, he is restricted from accessing his office or the Delhi Secretariat and cannot sign any files without the approval of Lieutenant Governor VK Saxena.

On Friday morning, Justices Ujjal Bhuyan and Surya Kant delivered separate verdicts on Kejriwal’s two pleas but concurred that the Chief Minister should be released.

Mr. Arvind Kejriwal also contested the CBI’s arrest, which occurred shortly after he was granted bail in the ED case by the Delhi trial court. His lawyers criticized this as an “insurance arrest.”

The judges had differing opinions on the matter. Justice Surya Kant saw “no hindrance” in the CBI’s arrest, while Justice Ujjal Bhuyan questioned why the agency took action “only after the trial court granted bail in the ED case.”

Regarding the issue of bail, the judges were in agreement, stating that the “completion of the trial (is) unlikely in the near future.” The court made a similar decision as in the cases of former Deputy Chief Minister Manish Sisodia and Telangana politician K Kavitha, both of whom were released on comparable grounds.

The court echoed its sentiment from Mr. Sisodia’s case, calling it a “travesty of justice” to keep Mr. Arvind Kejriwal in jail without a trial date, especially since he had already secured bail in the ED case, where he faced charges under the strict Prevention of Money Laundering Act (PMLA).

Justice Bhuyan expressed his confusion over the CBI’s sudden urgency to arrest Kejriwal just as he was about to be released in the ED case. He rejected Additional Solicitor General SV Raju’s argument that Kejriwal should first approach the trial court, stating, “This can’t be accepted.”

Justice Bhuyan also reinforced the legal principle that “bail is the rule, jail is the exception,” which had been a factor in the releases of both Mr. Sisodia and Ms. Kavitha. He emphasized that further detention by the CBI under the same predicate offense is unjustifiable, as the presumption of innocence stands.

This principle, established by Justice Krishna Iyer in 1977, remains valid, even in cases involving money laundering and anti-terrorism laws, as reaffirmed by the Supreme Court.

“Today, truth has once again prevailed over lies and conspiracies,” Sisodia stated. Atishi, who succeeded him as Delhi’s Education Minister, added, “Truth can face challenges, but it cannot be defeated.”

AAP MP Raghav Chadha also welcomed the decision, expressing how much the party had missed Kejriwal’s leadership. “Welcome back, Arvind Sunita Kejriwal, wife of Mr. Kejriwal, who gave passionate political speeches during her husband’s time in jail, stated that the BJP’s “schemes” had been foiled. “Their goal is to imprison opposition leaders to maintain their hold on power,” she remarked.

AAP's Momentum Ahead of Haryana Elections

Mr. Kejriwal’s release comes just weeks before the Haryana Assembly election, where his party plans to contest all 90 seats. The election is scheduled for October 5.

Although the AAP had engaged in discussions with Congress, its national ally through the INDIA bloc, the two parties couldn’t reach an agreement on seat-sharing. AAP sought to contest 10 of the 90 seats, but Congress was only willing to concede seven.
